ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF CONTRACT AND ACCESS TO THE WEBSITE

By accessing, viewing or using the materials, content or services accessible through the Website, the User makes it clear that they understand and accept these General Terms and Conditions of Contract, which define the rights and obligations of BIESOGEN and the User for contracting the services.

These are the only General Terms and Conditions applicable to the use of the Website (without prejudice to the fact that there may be specific conditions for certain services) and to the contracting of the services and replace any other conditions, unless previously agreed in writing between BIESOGEN and the User.

Access to the Website will not require the registration of Users. However, in order to contract the services offered by BIESOGEN, you will be required to provide us with personal data and the acceptance of these conditions before formalizing the corresponding payment.

PURPOSE OF THE WEBSITE

BIESOGEN has developed this Website to offer the User an appointment booking service to receive advice and advice on carrying out the analysis of the genetic profile.

The contracting of the services offered will be carried out between the User and BIESOGEN. The User, at the time of formalising the booking, will establish a direct contractual relationship with BIESOGEN.

RESERVATION

In order to make bookings through the Website, the User must provide their personal data (name, surname, e-mail and telephone number), or where applicable the data of the person on behalf of whom the activity is booked so that BIESOGEN can make the booking requested by the User.

By virtue of these General Terms and Conditions of Contract, Users declare to provide true, exact, current and complete data on their identity, or where applicable on behalf of the person on whose behalf the activity is reserved. In this regard, Users will be responsible for the accuracy of the data provided to BIESOGEN and for any consequences that may arise from errors in the information provided.

In accordance with the above, Users must immediately notify BIESOGEN through the teambsg@biesogen.com email or the contact form of any error, modification or problem regarding the data and information provided.

Free phone pre-visit

Explain to us the reason for your visit.

Approximate duration of 15 minutes

The rest of the visits can be carried out in person or by videoconference:

  • First consultation: your health history.

We ask you about family and medical history to evaluate your case.

  • Second consultation: we formalize your order.

We guide you through the test request form and informed consent. We verify that all the information is correct and send the collection kit.

CONDITIONS APPLICABLE TO RESERVATIONS

In general, the appointment booking promoted by BIESOGEN through the Website is subject to the following conditions:

The dates and times published on the Website have been defined and do not allow any type of modification in this regard.

It would only be possible to search for a date or time other than those offered by contacting BIESOGEN through the contact form available at the following link: https://localhost/biesogen/laboratorio-genetico-lleida.

To modify any data and/or date and time of an appointment already booked, the User will have to contact through the contact form available on https://localhost/biesogen/laboratorio-genetico-lleida or by sending an email to teambsg@biesogen.com.

The minimum time in advance to make the reservation is the day before. This particular aspect can be seen in the options proposed in the calendar of the Website.

BIESOGEN informs you that you may be required to submit the receipt that proves the reservation of the appointment prior to the start of the appointment, being able to present it in paper or digital format. If the user does not present the proof of reservation, they will not be able to carry out the free visit or consultations.

FACE-TO-FACE VISIT

It will be held at LoCowork Lleida (Av. de Miquel Batllori, 81-83, 25001 Lleida) in the date and time selected. The duration and all the necessary information for the appointment is detailed in the file, on the Website, as well as in the confirmation email sent by BIESOGEN to the User once the booking has been made.

VISIT BY VIDEO CALL

The video call can be made via computer, tablet or mobile phone.

To make the appointment by video call, it is essential to provide a valid email, necessary to be able to create and send the link to access the appointment.

On the day and time the appointment is booked, you have to access the link sent by email.

It is expressly prohibited, unless expressly authorised by the parties, to record the appointment by video call.

The User voluntarily accepts and assumes responsibility for the use of the applications necessary for the realization of video calls.

BOOKING PROCEDURE

You can browse the website until you find the appointment booking form. Once located, by following these steps, you can complete the reservation:

  1. Choose the purpose of the visit (cancer, dermatology, hormones, nervous system, etc.).
  2. Select an appointment for the free visit or for the first, second or third consultation.
  3. Indicate the date.
  4. Select the schedule.
  5. Fill in the data.
  6. Make the payment online.

CONTRACTING

The contracting of the reservation of BIESOGEN’s services will be understood to be formalized once the Users have completed and accepted the reservation form of the activity and it has been confirmed, after having correctly completed the reservation process and the payment of the same has been correctly made.

PAYMENT METHOD, PRICE, CURRENCY AND TAXES

Prices will be as indicated by BIESOGEN at the time of booking.

All services are immediately confirmed and are paid at the time of booking by:

  • Credit or debit bank card, with the payment gateway of the Santander financial institution. Visa and Mastercard credit cards are accepted.

In general, BIESOGEN makes the full payment through the Website.

These prices are expressed in Euros (€) and including taxes, and the total amount will be indicated at the time of the final confirmation of the contracting of the service.

In general, BIESOGEN will not apply discounts on the provision of its services, unless this is established in the conditions of each booking.

BOOKING CONFIRMATION AND CANCELLATION

After contracting the reservation, Users will receive a confirmation email confirming the charge for the contracted service and will be provided with a receipt/acknowledgement of purchase of the contracted services. The User must bear in mind that this purchase receipt is not equivalent to the issuance of the invoice corresponding to the contracting of the services. The User may request the invoice once they have formalized their reservation through the website to the email teambsg@biesogen.com.

In the event of any undue or fraudulent charge on the card used for the purchase through https://biesogen.com, BIESOGEN can take the appropriate steps in the shortest possible time.

CANCELLATION POLICY

Users may cancel free of charge up to 24 hours before the booked appointment. If they cancel with less notice, arrive late or do not show up, no refund will be offered.

To cancel any appointment, the User will have to communicate his/her decision to cancel it through the contact form available on https://localhost/biesogen/laboratorio-genetico-lleida or by sending an email to teambsg@biesogen.com. We recommend using the following form format:

CONDUCT ON THE WEBSITE

Users undertake to make lawful, diligent, honest and correct use of any information or content they have access to through the Website, and all this under the principles of good faith and respecting at all times the legislation in force and these General Terms and Conditions of Contract.   • Download, send or otherwise distribute content or applications that may violate any applicable law or infringe any rights of any party.

BIESOGEN reserves the right to deny any attempt to access the Website or cancel user accounts, in cases where there is incorrect use of the Site in accordance with the provisions of this clause.

EXCLUSION OF LIABILITY

Without prejudice to the responsibility in the reservation of appointments to which the provisions of the General Law of Consumers and Users are applicable, including but not limited to, BIESOGEN is not responsible for the following circumstances:

  • Cancellations made after the deadline by Users. BIESOGEN will not be responsible under any circumstances for refunding the amounts paid by its Users when they have not complied with the cancellation period provided for in the cancellation policy.
  • Delays or errors made by Users in arriving at the appointment. BIESOGEN will not assume any responsibility if the User misses the booked appointment due to lack of punctuality.
  • In cases where the User does not carry the corresponding booking receipt printed on paper and/or downloaded to their mobile phone and the corresponding appointment is denied.

MODIFICATIONS

BIESOGEN reserves the right to make as many modifications as it deems appropriate to these General Terms and Conditions of Contract. These modifications will be valid from their publication on the Website.

SAFEGUARD CLAUSE

All clauses or extremes of these General Conditions of Use must be interpreted independently and autonomously, and the rest of the stipulations will not be affected in the event that one of them has been declared null and void by a court ruling or final arbitration decision. The affected clause or clauses will be replaced by another or others that preserve the effects sought by the General Terms and Conditions of Contract.

Governing Law and Jurisdiction

This place is located and operated in Spain. These General Terms and Conditions of Contract shall be governed by Spanish law. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the competent courts and tribunals of Spain, without giving effect to principles of conflicts of law.

In those cases in which the customer does not have the status of consumer or user, or who is domiciled outside Spain, he or she will submit to the Courts and Tribunals of Lleida, expressly waiving any other jurisdiction that may correspond.

COMPLAINTS AND CLAIMS

In addition, BIESOGEN has official complaint forms available to consumers and users, which they can request from BIESOGEN at any time, using the contact details provided at the beginning of these Terms (General Information). Likewise, if the relationship between BIESOGEN and the User issues a dispute, the User as a consumer, may request an out-of-court dispute resolution, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters.
